Air France Flight 358 Class Action Lawsuit and Settlement
On August 2, 2005, Air France Flight 358 en route from Paris to Toronto overran the runway at Pearson International Airport. The Airbus A340 came to a stop in a gulley and burst into flames. Thankfully, all passengers and crew members survived, but passengers suffered both physical and emotional injuries. The baggage of the majority of passengers was damaged or destroyed.
On August 5, 2005 a class action commenced with Hussein Abdulrahim and Fadi Abedrabbo acting as representative plaintiffs for the passengers. The Defendants were Air France as air carrier and operator of the flight; Alain Rosayc as Captain; F. Naud as First Officer; NAV Canada as provider of air traffic control and navigation services at the airport; the Greater Toronto Airport Authority; Airbus as manufacturer of the aircraft; and Goodrich Corporation as manufacturer of the emergency evacuation system and slides for the aircraft.
The lawsuit was certified as a class action in August 2006. In January 2011 the class action was settled in the Ontario Superior Court before Justice Strathy for a sum of $20,750,000.
